The DUI Defense Key

Experience is the key. Your choice of an attorney in a DUI case can make the difference between a successful defense and a conviction. While it may be the most often committed crime in the country, generally speaking, most people charged with DUI have never been arrested or had problems with the law before.

This area of the law is unlike any other. Since the crime of DUI involves an individual's response to drinking alcohol, two people can commit the same act (for instance drinking equal amounts of alcohol) and one will be impaired and DUI while the other may be barely affected and not in violation of the law. A conviction or acquittal may turn on the attorney's knowledge and experience with the principles of biology, pharmacology, field sobriety exercises, infrared breath testing, or head space gas chromatography, just to name a few. Many otherwise well qualified criminal defense attorneys simply have not been trained in the many areas of science necessary to properly defend a DUI case.

Technical applications of the law are also extremely important in the defense of drinking drivers. The Georgia DUI law itself has been amended eighteen (18) of the past twenty (20) years.

Furthermore, many of the defendant's constitutional rights with which we have become familiar simply do not apply to an individual charged with DUI. For instance you are NOT required to be given the "right to remain silent" Miranda rights and you do NOT have the right to an attorney to help with your decisions when being arrested for DUI. The Fifth Amendment right not to incriminate yourself does NOT apply to DUI blood or breath testing. Once the test results are admitted at trial there is even a possibility that you could lose the presumption of innocence and that the judge will instruct the jury to infer your guilt. Under the Administrative License procedure which exists in Georgia, you can even lose your drivers license before your case ever goes to court.
