Six Things You Should NOT Do After Being Pulled Over for DUI

You are freaking out. The police are right behind you. You almost can’t believe it. You are being stopped for DUI. Will you be arrested? Maybe not – if you make sure to follow these simple steps. Here's what NOT to do after being pulled over for DUI.

First of all, KEEP QUIET! We can't emphasize this enough. Police are gunning for you. They want you to spill your guts about your evening. They are hoping you tell them where you have been, what you have been doing and of course, what you have been drinking. Instead of giving them what they want, give them the right answer. Say, "I'd really like to speak to my lawyer before I answer any of your questions."

Next up, DON'T TAKE A FIELD SOBRIETY TEST! You don't have to. They are optional! Trust us, the police will never tell you that. But it's true. Field sobriety tests are not required. They are too subjective. However, if you do take one, prosecutors will be able to use the evidence collected against you. So make sure you exercise your rights to NOT take a field sobriety test.

Also, DO NOT BE BELLIGERENT! Police are recording everything you do. If you are acting out, you will be hurting yourself. Prosecutors will use any evidence that they collect against you. If you are behaving like a drunk person, then you are helping the state build a case against you.

DON'T FUMBLE WITH YOUR THINGS! This is so important. Again, police are watching how you behave. If you are fidgety or jittery, it is more evidence that you are drunk. Instead of fumbling with your driver's license and registration when the cop asks for it, have it ready when the officer comes to your car. DON’T MAKE JOKES! This is not the time for a cop joke or any joke for that matter. Police officers take DUI stops very seriously. If you are acting like a comedian, police will not be amused. Instead, it'll make it more likely that you will piss off the cop – which means you will probably be arrested.

DON'T BE WILD! Act as calmly as you can when you are pulled over for DUI. Its okay to be nervous, but try to be calm and respectful to the police officer. This way you will have a better chance at being let go instead of arrested for DUI.
