BAT Certificate (I-5000) Mr. Siirtola was the first lawyer in the State of Arizona to purchase or obtain his own Intoxilyzer 5000 breath testing device. It was difficult for a criminal defense lawyer to obtain the device, sales of which are normally restricted by the manufacturer, CMI, Inc. to law enforcement agencies. CMI, the manufacturer of Intoxilyzer I-5000 evidential breath testing device, will not allow criminal defense lawyers to go through factory operators training for the device. Arizona law enforcement agencies, whether DPS, Sheriff's Departments, or local police departments, will not allow defense lawyers to go through local operator training courses for the Intoxilyzer 5000. Any I-5000 training is, therefore, difficult and very expensive for any criminal defense lawyer to obtain and can only be found outside the State of Arizona. Mr. Siirtola is one of a small number of Arizona lawyers trained by CMI factory-trained instructor(s) as an Intoxilyzer 5000 breath alcohol technician (BAT) /operator under national U.S. Department of Transportation (DOT) standards under 49 CFR Part 40. Jeffrey received an operator's certificate for all versions of the Intoxilyzer 5000, after passing fifty (50) operational subject test requirement with live subjects; study of the Operators Manual for the Intoxilyzer 5000; instruction from a retired DUI squad training officer, a medical doctor, and an electronics expert. The 24-hour operator course was taught to national standards and included CMI source materials, meeting and exceeding state-specific minimum law enforcement standards. Mr. Siirtola also received a field maintenance/quality assurance specialist certificate for the Intoxilyzer 5000 for monthly calibrations; quarterly and other preventive maintenance procedures taught to national standards and CMI source materials consistent with requirements of U.S. Department of Transportation 49 CFR Part 40. Mr. Siirtola has taught an Intoxilyzer 5000 operator course as an adjunct instructor, for field/wet workshop portion of the Operators Course.
